1. Introduction and Acceptance

These Terms of Service ("Terms") form a binding legal agreement between you ("you", "your", or "User") and Cricket-Edges ("we", "us", "our"), governing your access to and use of the Cricket-Edges website, application, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Service.

2. Definitions

  • "Account" means a registered user account on the Service.
  • "Content" means all data, statistics, projections, models, charts, written analysis, code, graphics, and other materials made available through the Service.
  • "Subscription" means a paid plan granting access to specific Service features.
  • "Intellectual Property Rights" means copyright, trade marks, database rights, patents, design rights, know-how, and all other intellectual property rights, whether registered or unregistered.

3.1 Age Requirement

The Service is available only to individuals aged 18 years or older. By creating an Account, you warrant that you are at least 18. We reserve the right to suspend or terminate any Account where we have reasonable grounds to believe this warranty has been breached.

3.2 Jurisdiction

The Service is intended for use by residents of the United Kingdom, New Zealand, and Australia. You are responsible for ensuring that your access to and use of the Service is lawful in your jurisdiction.

3.3 Capacity

By accepting these Terms, you warrant that you have the legal capacity to enter into a binding contract and that you are not prohibited from receiving the Service under any applicable law.

4. The Service: What We Provide

4.1 Nature of the Service

Cricket-Edges is an analytics and information service. It provides statistical models, historical data, projections, and commentary relating to cricket markets and matches. The Service is intended to support informed decision-making by adult users and is provided for informational and entertainment purposes only.

4.2 What the Service Is Not

The Service does not:

  • Constitute betting, wagering, or gambling advice;
  • Constitute financial, investment, tax, or legal advice;
  • Place bets or wagers on your behalf;
  • Guarantee any outcome, profit, or return;
  • Operate as a licensed bookmaker, betting exchange, or financial services provider.

You alone are responsible for any decisions you make on the basis of, or influenced by, Content provided through the Service.

4.3 Service Availability

We will use reasonable efforts to keep the Service available, but we do not guarantee uninterrupted, error-free, or secure access.

4.4 Changes to the Service

We may add, modify, suspend, or remove features at any time. Where changes materially reduce the functionality of a paid Subscription, we will offer affected users a pro-rated refund or comparable remedy as required by applicable consumer law.

5.1 No Guarantee of Outcomes

Sport is inherently uncertain. Statistical models and historical performance data cannot and do not predict future results with certainty. Past performance is not a reliable indicator of future outcomes.

5.2 No Guarantee of Profit

We make no representation, warranty, or guarantee that use of the Service will result in any profit, positive return, or improved wagering performance. You may lose money, and may lose all sums staked, regardless of how the Service is used.

5.3 You Bear All Risk

If you choose to wager money on the basis of Content from the Service, you do so entirely at your own risk and on your own judgment. We accept no responsibility for any losses, missed gains, costs, or other consequences arising from such decisions, to the maximum extent permitted by law.

5.4 Independent Verification

Statistical data may contain errors or omissions. We recommend you independently verify any Content before relying upon it.

5.5 Compliance with Local Gambling Laws

You are solely responsible for ensuring your wagering activity complies with the laws applicable to you, including those of the UK Gambling Commission, New Zealand (Gambling Act 2003), and the relevant Australian state or territory.

7. Account Registration and Security

You must provide accurate, current, and complete information when creating an Account and keep it up to date. You may hold only one Account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your Account. Accounts are personal and may not be sold, transferred, or shared.

8. Acceptable Use

You agree that you will not:

  • Use the Service in violation of any applicable law or regulation;
  • Use the Service to facilitate match-fixing, insider wagering, or any other corrupt practice;
  • Resell, sublicense, or commercially exploit the Service or Content without our prior written consent;
  • Scrape, crawl, or extract Content using automated means without our written permission;
  • Reverse engineer or decompile any part of the Service;
  • Bypass, disable, or interfere with security or access-control mechanisms;
  • Upload or transmit malicious code or material designed to disrupt the Service;
  • Misrepresent your identity, age, location, or affiliation.

9. Intellectual Property

All Intellectual Property Rights in the Service and Content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use only. You must not use the Service or Content to develop, train, or fine-tune any machine-learning model or competing analytics product.

10. Subscriptions, Fees, and Payment

Subscription fees are billed in advance on a recurring basis and automatically renew until cancelled. You may cancel at any time via your Account settings; cancellation takes effect at the end of the current billing period. We may change pricing on at least 30 days' written notice. Except where required by mandatory consumer law, fees are non-refundable.

11. Termination

You may terminate your Account at any time. We may suspend or terminate your Account where you materially breach these Terms, where required by law, or where continued provision presents a security or legal risk. On termination, your right to access the Service ceases immediately. Sections 5, 9, 12, 13, and 15 survive termination.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or opportunity;
  • We will not be liable for any wagering losses arising from your use of the Service;
  • Our total aggregate liability is limited to the greater of (a) fees paid by you in the preceding 12 months, or (b) NZ$100.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

13. Indemnity

You agree to indemnify and hold harmless Cricket-Edges, its directors, officers, employees, and contractors from all claims, liabilities, damages, and expenses arising out of your breach of these Terms, your violation of any law or third-party rights, or any wagering activity you undertake on the basis of Content from the Service.

14. Consumer Rights

Nothing in these Terms excludes any non-excludable consumer rights. UK consumers have rights under the Consumer Rights Act 2015. New Zealand consumers have rights under the Consumer Guarantees Act 1993. Australian consumers have rights under the Australian Consumer Law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction, subject to mandatory consumer forum rights. Before commencing formal proceedings, you agree to attempt in good faith to resolve any dispute with us for at least 30 days.

16. Modifications to These Terms

We may amend these Terms from time to time. For material changes, we will give at least 14 days' advance notice by email or in-app notification. Continued use after the effective date of changes constitutes acceptance.

17. Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, pandemic, government action, internet failures, or failure of a sub-processor.

18. General Provisions

  • Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions continue in full force.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our written consent.
  • Language. These Terms are provided in English; the English version prevails over any translation.
